Creator-Specific Terms and Conditions
These Creator-Specific Terms apply to all users who register as creators on the EQ Content platform (“Creators”). By registering as a Creator, accepting a Brief, or participating in a Campaign, you agree to be bound by these terms in addition to EQ Content’s general Terms and Conditions.
1. Creator Subscription
Creators access the EQ Content platform via a paid subscription.
The Creator subscription is billed on a monthly rolling basis and will automatically renew each month unless cancelled. Creators may cancel their subscription at any time, with cancellation taking effect at the end of the current billing period. No refunds are issued for partially used subscription periods.
EQ Content reserves the right to amend subscription pricing upon reasonable notice.
2. Acceptance of Briefs
When a Creator applies for and accepts a Brief, a binding agreement is formed between the Creator and the Brand, facilitated by EQ Content. The Creator agrees to deliver the content (“Deliverables”) exactly as outlined in the Brief, including content format, style, deadlines, and usage requirements.
3. Platform Fee on Paid Work
Where a Creator is paid for Deliverables through the EQ Content platform, EQ Content will deduct a platform service fee equal to 10% of the agreed creator payment.
The platform fee is deducted automatically prior to payout and covers platform operation, payment processing, and creator support services.
4. Gifted Products
Where a Brand supplies a product to a Creator for the purpose of creating content (“Gifted Product”), the product is provided solely for the purpose of content creation and on a conditional basis.
Ownership of the Gifted Product will only transfer to the Creator once the agreed Deliverables have been completed and accepted in accordance with the Brief.
5. Failure to Deliver Content
If a Creator fails to deliver the agreed Deliverables by the deadline specified in the Brief (or within any agreed extension period), the Brand may, at its discretion, require the Creator to:
a) return the Gifted Product in reasonable condition at the Creator’s own expense; or
b) pay the Brand the full retail value of the Gifted Product as stated in the Brief and accepted by the Creator prior to dispatch.
Any such payment represents a genuine pre-estimate of loss and is not intended to operate as a penalty.
6. Retail Value Disclosure
The retail value of any Gifted Product will be clearly stated in the Brief prior to acceptance. By accepting the Brief, the Creator confirms they have reviewed and agreed to this stated value.
7. Deadlines and Communication
Creators must meet all deadlines outlined in the Brief and maintain reasonable communication with the Brand and/or EQ Content throughout the Campaign. If delays or issues arise, the Creator must notify the Brand as soon as reasonably possible.
Failure to communicate may be treated as a failure to deliver the Deliverables.
8. Content Usage Rights
By submitting content through EQ Content, creators agree that the commissioning brand is granted lifetime, royalty-free, worldwide usage rights to the approved content.
This includes, but is not limited to, use across organic social media, paid advertising, websites, email marketing, and other digital or physical marketing channels.
Brands may edit, crop, or repurpose the content as required for their marketing needs.
Creators acknowledge that this usage is included within the agreed compensation and that content usage rights cannot be revoked once content has been approved and delivered.
9. VIP Creator Status
Creators may become eligible for VIP Creator Status by successfully completing 20 jobs on the platform and receiving 5-star reviews from Brands for those jobs.
VIP Creator Status is awarded at the discretion of EQ Content. Once a Creator meets the eligibility criteria, EQ Content will notify the Creator and provide details of the next steps and any additional benefits associated with VIP status.
EQ Content reserves the right to amend, suspend, or withdraw VIP Creator Status at any time, including where a Creator’s performance, conduct, or reviews no longer meet platform standards.
10. Platform Enforcement
In addition to any remedies available to the Brand, EQ Content reserves the right to take reasonable enforcement action against Creators who fail to meet their obligations, including but not limited to:

Suspension or termination of the Creator’s account

Restriction from applying for future Briefs

Withholding of payouts or platform credits
These measures are intended to protect Brands and maintain the integrity of the platform.
11. Disputes
If a dispute arises relating to delivery, content quality, payments, or Gifted Products, EQ Content may, at its discretion, review the matter and assist in facilitating a resolution. EQ Content does not guarantee dispute outcomes but aims to act fairly and reasonably for all parties.
12. Independent Contractor Status
Creators participate on the platform as independent contractors. Nothing in these terms creates an employment, partnership, or agency relationship between EQ Content, Brands, and Creators.
13. Governing Law
These Creator-Specific Terms are governed by and construed in accordance with the laws of England and Wales.
