Brand-Specific Terms and Conditions

These Brand-Specific Terms apply to all users who register as brands on the EQ Content platform (“Brands”). By registering as a Brand, purchasing a subscription, or posting a Brief, you agree to be bound by these terms in addition to EQ Content’s general Terms and Conditions.

1. Brand Subscription

Brands access the EQ Content platform via a paid subscription.

The Brand subscription is billed on a monthly rolling basis and will automatically renew each month unless cancelled. Brands may cancel their subscription at any time, with cancellation taking effect at the end of the current billing period. No refunds are issued for partially used subscription periods.

EQ Content reserves the right to amend subscription pricing upon reasonable notice.

2. Posting Briefs

When a Brand posts a Brief, the Brand agrees to clearly outline all requirements, including but not limited to:

  • Content deliverables and format

  • Deadlines and timelines

  • Payment amount for the Creator

  • Any revision requirements

  • Whether a product will be gifted and the stated retail value

Brands are responsible for ensuring that Briefs are accurate, clear, and achievable.

3. Payment Terms

Brands agree to pay Creators upfront as specified in the Brief. Creator payments must be funded through the EQ Content platform before work commences.

Once a Brief has been accepted by a Creator, payments are non-refundable. Brands are entitled to revisions in accordance with the Brief but are not entitled to refunds.

EQ Content facilitates payments between Brands and Creators but is not responsible for the quality or outcome of Deliverables.

4. Revisions

Brands may request revisions strictly in line with what is specified in the accepted Brief. Requests for work outside the original scope may require additional payment and creator agreement.

Brands must review submitted Deliverables within a reasonable timeframe. Failure to respond or request revisions within this timeframe may be treated as acceptance of the Deliverables.

5. Gifted Products and Shipping Obligations

Where a Brief involves a gifted product, the Brand agrees to:

  • Dispatch the correct product to the Creator promptly following acceptance of the Brief

  • Cover all costs associated with shipping the product to the Creator

  • Provide accurate delivery information and timelines

Failure to ship the product within a reasonable timeframe may result in delays to Deliverables for which the Creator and EQ Content are not responsible.

6. Creator Non-Performance

If a Creator fails to fulfil their obligations under an accepted Brief, EQ Content will take reasonable steps to resolve the issue. Where appropriate, EQ Content will source an alternative Creator to complete the Brief.

Brands acknowledge that this replacement constitutes the primary remedy and that refunds are not provided in such circumstances.

7. Platform Role and Limitations

EQ Content acts as a neutral platform facilitating connections, payments, and communication between Brands and Creators. EQ Content does not guarantee specific outcomes, performance results, or content effectiveness.

EQ Content is not a party to the agreement between Brands and Creators but may assist in dispute resolution at its discretion.

8. Disputes

In the event of a dispute, Brands agree to engage reasonably and in good faith. EQ Content may review disputes and assist in facilitating a resolution but does not guarantee specific outcomes.

9. VIP Creator Status

EQ Content may designate certain Creators as “VIP Creators” based on platform performance and reviews. VIP status does not guarantee specific results but indicates a history of consistent performance on the platform.

10. Independent Contractor Relationship

Creators engaged through the platform operate as independent contractors. Nothing in these terms creates an employment, partnership, or agency relationship between Brands, Creators, or EQ Content.

11. Governing Law

These Brand-Specific Terms are governed by and construed in accordance with the laws of England and Wales.
